SAN FRANCISCO – Every cell phone sold in San Francisco could soon come with a label detailing the level of radiation you will be exposed to by using it and recommending a headset to avoid radiation exposure.

If a proposal endorsed Monday by the Commission on the Environment’s policy committee – and preliminarily supported by the mayor – moves forward, not only would consumers be alerted of potential risks of cell phone radiation, but it could become illegal to promote the
devices in public schools, and the federal government would be officially called upon to change their standards for cell phones.

The committee’s 3-0 vote came in response to some scientific studies that suggest cell phone radiation can, over long periods of time, cause brain tumors on the side of the brain where the phone is held, and men who carry cell phones in their pocket may experience lower sperm counts.

The U.S. Federal Trade Commission has recently adopted new guidelines regarding the usage of endorsements and testimonials in advertising. These guidelines will affect you as Associates because, in the view of the FTC, you are considered endorsers. “Advertising” is also a general term defined as “verbal statements, demonstrations, or depictions of the name, signature, likeness or other identifying personal characteristics of an individual or the name or seal of an organization” and is not restricted to paid placements in media.

All Associates should take time to read this document and become familiar with the FTC’s new requirements.You may also wish to view several FTC videos available here, but it is not a substitute for reading the new rules.

Statements such as “results not typical” or even “these testimonials are based on the experiences of a few people and you are not likely to have similar results,” while formerly helpful, will no longer protect you or Max against possible FTC sanctions.
